Witness protests International Criminal Court failure to

withdraw his evidence against William Ruto

 

NAIROBI,KENYA: An International Criminal Court (ICC) Witness who withdrew his evidence against the Deputy President William Ruto has protested over failure by the trial chamber to acknowledge his affidavits. In his petition, the witness identified as K15 faults ICC over its continued insinuation that he was still their witness despite having forwarded four sworn affidavits to the prosecutor’s office withdrawing all the audio and written statements attributed to him. The witness whose testimonies the prosecutor’s office used in obtaining confirmation of charges in the case involving Deputy President and Radio Journalist Joshua Arap Sang, withdrew his evidence in February this year and wants the ICC to remove his name from the list of witnesses. In his petition he exposes how witnesses were coached by the prosecution, he also bares the dishing out of money to witnesses by ICC officials and how they had extracted evidence fromwitnesses under the influence of alcohol. “I am aware that the prosecution presented a total of approximately 3,000 pages of evidence which they attributed to me when the case came up for confirmation but I withdrew as a witness in a sworn affidavit dated February 7, 2013, which was forwarded to the prosecutor’s office by my advocates,” thewitness submitted in his petition. He noted that the office of the prosecutor has however failed to confirm to him or his lawyers whether they received the affidavits or that they had removed his name from the list of prosecution witnesses.

 

“The office of the prosecutor continues to regard me as a prosecution witness when I am not and this has now constrained me to directly write to the chamber for the purposes of raising some issues that may be of interest to the court and the parties to the matter now pending before this court,” he submitted. He expresses concern over the process and the manner in which his alleged statements were obtained by the investigators and the office of the prosecutor and the events that occurred prior to the confirmation of the Charges. “I do this in appreciation of the fact that the Rome Statute whose contents I have familiarized myself with over time requires that a trial must be based on truth and that there must be impartial investigations,” he argued. He recalls that he was approached by the Office of The Prosecutor (OTP) to be their witness in the case in the year 2010 and he was designated as witness number 8 during the confirmation hearing and as K15 by Victims and Witness Unit (VWU). “I am aware that several other people were recruited as witnesses. The office of the prosecutor never conducted any investigations on the ground as the basis for what they are calling my testimony,” he submits. - The Standard.

Visa launches global money transfer service in Kenya

Payment card firm Visa on Thursday launched an international money transfer service in partnership with Equity Bank as the battle for the local electronic payment market grows fierce. Dubbed Visa Personal Payments (VPP), the service will allow Equity Bank customers with Visa branded cards to send money to other visa card holders domestically and across the world at a near-instantaneous speeds. Equity Bank projects that VPP will give it a competitive edge as it targets the billions of shillings that flow back to Kenya in diaspora remittances. “It is going to generate a lot of interest to our people in the diaspora because it will mean that someone in the US and Europe can transfer money directly to his relatives in Kenya,” said Equity Bank chief operations officer, Mr Julius Kipng’etich. Money transfers will be authorised from Equity Bank ATMs and its mobile banking channel. Equity Bank is the first financial institution in Africa to qualify as an originator of funds under the VPP system. Visa indicates that it will expand VPP to other banks in the region. Visa and Equity Bank will be stepping into a space dominated by Western Union and MoneyGram as well as mobile money service providers such as M-Pesa. A Sh50,000 domestic transfer costs about Sh50 while sending the same amount of money across borders will be charged Sh300. It can cost up to Sh1,000 to send a similar amount of money from the United States to Kenya via Western Union. - Daily Nation.

To ask Her Majesty’s Government what representations they are making to the Government of Kenya concerning the impact within the region of the outcome of the recent presidential election in that country.

Lord Chidgey: My Lords, this is a remarkable year for Kenya. In December, it will celebrate 50 years of independence from Britain, after Kenya’s founding father, Jomo Kenyatta, took over the reins of government as Prime Minister in 1963. A year later, Kenya’s Parliament amended the constitution to make Kenya a republic, with Jomo Kenyatta as its first President.

There was much pessimism during Kenya’s build-up to independence. Kenyatta had been tried, convicted and imprisoned by the British for “managing” the armed insurrection known as the Mau Mau on charges that were widely regarded as spurious. He was described by a former British governor as the,

“leader to darkness and death”.

Yet he was instrumental, even in the sensitive areas of the so-called White Highlands, in calling for peace and unity. When he died in 1978, he was admired—in an

era of instability in post-independence Africa—as having presided over stability and economic advance for his country.

Today his oldest son, Uhuru Kenyatta, is the fourth President of Kenya since independence. He was elected in March when, again, there were gloomy forecasts of violence, chaos and political instability. Like his father, Uhuru Kenyatta can take considerable credit for peaceful elections, particularly when elaborate electronic equipment failed and Kenyans had to endure a week of waiting as the votes were counted manually.

Kenyatta and his Jubilee Alliance were clear winners and thus avoided a run-off against his main political opponent, Raila Odinga and his Coalition for Reform and Democracy. The Jubilee Alliance won by just 8,000 votes, a victory confirmed by Kenya’s Supreme Court. Raila Odinga must take credit, too, for accepting the result, which unquestionably kept his supporters off the streets. Kenya, South Sudan move to fast-track LAPSSET project

Kenya: President Uhuru Kenyatta and his South Sudan counterpart Salva Kiir Mayardit have agreed to fast-track implementation of the Lamu Port and Lamu Southern Sudan-Ethiopia Transport Corridor project.  Uhuru and Kiir also said the two countries will jointly source funding for the upgrading of the road linking the two countries for mutual benefit of their people. The two were addressing the Press after holding talks in Juba yesterday when Uhuru made a stop-over on his way to Addis Ababa, Ethiopia for the 21st Ordinary Session of the Assembly of the African Union Heads of State and Government. Uhuru particularly emphasised completion of the project and improvement of the road linking Kenya and South Sudan were viable projects that would enable people of the two countries to interact freely and boost trade between them. “The two projects were the main focus of our bilateral talks today,” Uhuru said, adding the projects will also promote cross border security. He reaffirmed Kenya’s support to the full implementation of the Sudan Peace Accord. - The Standard.

 

 

 

Crowds mourn literary giant Achebe at hometown funeral

 

Hundreds of mourners gathered on Thursday in the hometown of Nigerian novelist Chinua Achebe for the funeral of the man regarded as the father of modern African literature and the author of the widely praised "Things Fall Apart." Heavy security was in place throughout the small southeastern town of Ogidi, with President Goodluck Jonathan along with foreign dignitaries attending the service at the local Anglican church. Pallbearers dressed in dark suits and purple ties carried Achebe's wooden coffin up the church aisle and placed it atop a pedestal covered in white cloth at the start of the service. A number of women mourners wore purple headwraps and white dresses, while some men dressed in traditional shirts adorned with Achebe's picture. Access inside the church was granted only by invitation, but several thousand people flocked to tents with loudspeakers set up outside. "I left my house in Asaba (a nearby city) at 5:00 am this morning in order to pay my last respects for this illustrious son of Nigeria who has done his people proud," said Sylvanus John, a 31-year-old engineer. Groups of admirers could be seen dancing and singing in the Igbo language spoken throughout the region in the streets of the town in praise of the writer. Achebe, who died in the United States in March aged 82, is viewed as an iconic figure in Nigeria and abroad, and his death led to tributes worldwide.

Implement Truth team report, ODM says

The Orange Democratic Movement (ODM) has demanded the full implementation of the Truth, Justice and Reconciliation Commission report despite it adversely mentioning party members. Fielding questions from journalists after a parliamentary group meeting attended by 70 members of the Senate and the National Assembly, deputy Minority Leader Jakoyo Midiwo said the TJRC report should be tabled in the House for debate and be implemented. "We want full implementation of the TJRC report with full participation of Parliament," said Mr Midiwo. "Anybody whether big or small who is implicated in the report should face full force of the law so that justice can be done to those affected." Mr Midiwo, however, said ODM was waiting to see the report and peruse it before issuing a comprehensive statement on way forward. Kenya economy to grow by 6 percent in 2013, Devolution Cabinet Secretary says

Nairobi, KenyaKenya's economy is expected to grow by about 6 percent in 2013, up from a growth rate of 4.6 percent last year, driven by growth in sectors like agriculture, Devolution and Planning Cabinet Secretary Anne Waiguru said on Thursday. Optimism around the growth prospects for east Africa's biggest economy has risen after the country held a peaceful presidential poll in March, in contrast with the violence-riddled election of five years ago. The Cabinet Secretary made the announcement during the launch of the country’s economic survey. Waiguru said the country would focus on implementing the economic plan of the Jubilee coalition which won the polls in March. Waiguru attributed the outlook to a stable macroeconomic environment and increased investor confidence after the broadly peaceful elections. "We are expecting a positive growth if all goes as we expect (growth of) about 6 percent or so, "Waiguru said. - Reuters

One of the two men who tried to behead and disembowel a young soldier in Woolwich is a British citizen of Nigerian descent who became obsessed with Islamic extremism as a schoolboy, it was revealed today. Former classmates of Michael Adebolajo told the Standard how he started becoming interested in Islam aged 15 or 16 having been raised as a Christian. The heroism of three women who risked their lives to confront the Woolwich terrorists was today hailed by politicians calling for them to receive awards.

Uhuru nominates Lenku, Kambi to Cabinet

Nairobi, Kenya: President Uhuru Kenyatta has unveiled the names of the last two Cabinet Secretaries, a week after 16 others were sworn into office. Joseph ole Lenku has been nominated to the Ministry of Interior and Coordination of National Government and Samwel Kazungu Kambi to the Ministry of Labour, Social Security and Services. The President has subsequently forwarded the names to Parliament for approval. Kambi Kazungu is the former MP for Kaloleni constituency while Lenku is the Utalii College principal.

This was after selling him a car which he delivered at Mombasa Port but never provided the logo book. After flying back to UK he disappeared. The businessman has flown to the UK and he has managed to trace his house in Slough, Berks. Paul Kiboi promised to pay the money within two weeks. After that he disappeared again and then changed his telephone contacts. Kenya seeks to pull out of the ICC

Diplomats are due to discuss yet another document seeking to have Kenyans cases at the ICC withdrawn. KTN has learnt that diplomats from Kenya and other East African countries are seeking to secure an African Union resolution urging for the termination or suspension of the cases facing president Uhuru Kenyatta, his deputy William Ruto and radio journalist Joshua arap Sang. Woolwich Terror Murder Suspect Named

The two terror suspects being held under armed guard at hospitals in London were both known to security services, Government sources say. The men - one of whom has been named as Michael Adeboloja - were arrested following the hacking to death of a serving soldier in the street in Woolwich, southeast London. Sky's crime correspondent Martin Brunt said Adeboloja is a 28-year-old Londoner of Nigerian descent. "He was born in Lambeth, grew up in east London. There are still members of his family living in the area. "He was a student at Greenwich University, but it is not clear what he was studying there. High cost of mortgages fuelling housing deficit

Nairobi, Kenya: With just 20,000 home loans taken, owning a house remains the preserve of a few  High interest rates and inaccessibility to long-term funds have slowed the uptake of mortgage loans even as the country grapples with huge housing deficits in urban and rural areas, currently estimated at 200,000 and 350,000 units, respectively. According to analysts at Old Mutual Securities, the housing gap can partially be financed by mortgages, while cheaper solutions are required for lower-income groups, including housing microfinance and rental housing. The analysts, in a report titled Unlocking Housing Potential, say the potential size of the mortgage market in the country is currently Sh800 billion, which is around 13 times the current level. Mortgage accounts in the country stand at 20,000. According to the report, housing loans have remained the preserve of a few individuals, with the growth of the mortgage market stifled by unaffordability of the houses, low risk management, little access to funding and land issues.

 

Main players

The main players in the mortgages market include Housing Finance, Kenya Commercial Bank’s mortgage arm Savings&Loan, Standard Chartered Bank, Barclays Bank and Stanbic Bank. The mortgage industry, however, grew 48.5 per cent to Sh91.2 billion in 2011, but mortgage lending as a percentage of the gross domestic product stood at 2.6 per cent in 2012. “There have been some efforts to expand this reach by the industry. New entrants and aggressive marketing has resulted in some newer products,” acknowledges the report. Some of the efforts taken to revamp the mortgage business, according to the report, include introduction of fixed rate mortgages for between 10 and 20-year terms, and100 per cent financing. “One lender has also introduced mortgage insurance against the risk of a loss of income while the Retirement Benefits Authority in 2009 allowed pension contributions of up to 60 per cent to be used to secure a mortgage. This has the potential to leverage assets worth Sh290 billion and increase access for lower-earning people who have accumulated substantial pensions,” says the report. The Capital Market Authority’s plans to roll out real estate investment vehicles at the Nairobi Securities Exchange is also expected to make it possible for the public to invest in real estate developments by pooling their money in fund schemes managed by experts. - The Standard.

 

 

 

 

 

Uproar in Parliament over Ruto massage cartoon

 

NAIROBI, Kenya May 22 – Women MPs are demanding an apology from a Kenyan newspaper because of a cartoon it published on Wednesday, which they claim lowers their dignity.

 

Led by Kenya Women Parliamentarian Association Chairman Cecily Mbarire, they say the Daily Nation cartoon by Gado which shows Deputy President William Ruto getting a massage was in bad taste for women MPs who accompanied him on a now controversial four-nation African tour. “I want to demand an apology to all the lady Members of Parliament because we are here in our own right. We did not come here to massage anybody… we are here as Members of Parliament; and we want gender sensitive media, not people who look at us from the waist down and not the waist up.” Suna East MP Junet Mohammed was reprimanded by Speaker Justin Muturi after he said that only the women MPs who accompanied Ruto on the trip could clarify the matter. “I really condemn what this cartoon is trying to portray, but the members who travelled can tell us better,” he said. Majority Leader of Coalition Aden Duale sought to have Mohammed disciplined for imputing improper motive on the character of fellow legislators. “Is it in order for a Member of Parliament to stand up in this House and put very bad motive on his own colleagues, Mr Speaker? It is very, very shameful,” he said. Mbita MP Millie Odhiambo urged the Speaker to ensure the media gives Members of Parliament equal coverage. “I am not too sure that there is anything there that seems to suggest that those are female MPs who are massaging. My concern is if they put a cartoon of women massaging William Ruto, then I want to demand that they put a cartoon of me being massaged by male MPs.” Speaker Muturi refused to be drawn into the making a ruling and asked MPs who felt aggrieved to petition the House Committee on Parliamentary Broadcasting to look into the matter and file its recommendations after 14 days.

Woolwich machete attack leaves man dead

A man has been killed in a machete attack and two suspects shot and wounded by police in Woolwich, south-east London. The Met Police said a murder inquiry was being led by its Counter Terrorism Command. Prime Minister David Cameron said the UK would "never buckle" in the face of terror attacks. Footage has emerged showing a man wielding a bloodied meat cleaver and making political statements. Police confirmed two men had been arrested in connection with the murder. There are unconfirmed reports that the dead man was a soldier. Both French President Francois Hollande and MP Nick Raynsford said the dead man had been a soldier at Woolwich barracks. The footage shown on the ITV website shows a man, speaking to the camera, saying: "We must fight them as they fight us. An eye for an eye, a tooth for a tooth." He added: "I apologise that women have had to witness this today, but in our land our women have to see the same. You people will never be safe. Remove your government, they don't care about you."

ITV News has broadcast footage of a man with bloodied hands talking to a camera, following a machete attack in south-east London. He makes a series of political statements before walking towards a man, who is believed to be a soldier, lying on the street. Kenyatta led elite in land grabbing

 

The regime of Kenya’s first president, Jomo Kenyatta, was riddled with land grabbing which was perpetrated by him for his benefit and members of his family. The Truth Justice and Reconciliation Commission report says that the injustice also benefitted other political leaders from other tribes. The report released Tuesday revealed that between 1964 and 1966, one-sixth of European settlers’ lands that were intended for settlement of landless and land-scarce Africans were cheaply sold to the then President Kenyatta and his wife Ngina as well as his children. – FULL STORY

 

 

 

Probe these people, says TJRC

 

More than 30 sitting and former MPs or senators are among prominent personalities facing fresh prosecutions following allegations that they were behind the election violence that led to the killing of 1,133 people in 2007/2008. Many others will also be investigated or prosecuted in connection with serious crimes, including assassinations, theft of public land and inciting people to violence, according to recommendations made by the Truth, Justice and Reconciliation Commission (TJRC), whose report was handed to President Kenyatta on Tuesday. President Kenyatta and his deputy, Mr William Ruto, also feature in the report over claims that they masterminded the 2007 poll violence, but were spared any local action because they are facing the same charges before the International Criminal Court (ICC). Many of those facing fresh investigations over the post-election violence would be accused based on the controversial report of the Kenya National Human Rights Commission, “On the Brink of the Precipice. A Human Rights Account of Kenya’s post-2007 Election Violence”. Mining Cabinet Secretary Najib Balala is accused of inciting and funding violence, according to the KNHRC report, which called for him to be investigated. Kisii Senator Chris Obure is also recommended for investigation over the 1991/1992 ethnic clashes. Some of those mentioned adversely include former MPs William ole Ntimama (Narok North), Henry Kosgey (Tinderet), Dr Sally Kosgei (Aldai), Fred Kapondi (Mt Elgon) and Boaz Kaino (Marakwet West). “It happened on August 13, 2007. It was a Wednesday and I was at home in Meru with my father, a man I was very close to and whom I felt secure with.  We enjoyed each other’s company and often jogged and played chess and darts together. He was an engineer. My mother, an epidemiologist, worked for the Ministry of Health. She had travelled to Eldoret the previous day, where there was a disease outbreak. My younger sister was in school for holiday tuition while my older brother, then a student, was at Moi University. My older sister was married. I was in Form Four at Chogoria Girls’ Secondary School and was home for the holidays. That morning, my father had ordered the house boy to visit his family, pointing out that there was not much to be done. My father and I went about our usual daily routine and even jogged in the afternoon. We had supper at 8pm, then played chess and darts until 10pm, when he excused himself, saying that he wanted to sleep early. Shortly afterwards, I went to my room and changed into my nightdress, then continued to play darts on my laptop.

 

 Much later, it was about 2am, I saw the doorknob turn. The door opened and my father came in, wearing only his underwear. I quickly grabbed a gown and wrapped it around myself. I threw another one at him and told him to cover himself, which he did. I thought that he had come to find out why I had not yet slept. He sat next to me on the bed, took away my laptop, and covered my mouth with a cloth. Then he raped me. He was too strong, I could not fight back. Then he left. I sat on my bed in disbelief. I was bleeding and in pain. I had never been intimate with anyone in any way. All I could do was cry. I did not know whom to turn to. My father had violated me. I felt betrayed. I tried to get off the bed but could hardly move. But I had to. Eventually, I decided to find out whether he was still inside the house. In my state of mind, I figured that he was the only one who could help me since my mother was not around. On opening his bedroom door, the first thing I saw was blood on the floor, lots of it. He had stabbed himself, and next to him was a suicide note addressed to my mother. It read: “I fell in love with your daughter. I had sex with her. Presiding judge quits Ruto trial at The Hague

 

A new judge will now preside in the case against Deputy President William Ruto and broadcaster Joshua Sang after Judge Kuniko Ozaki asked to be excused. Ozaki will continue to be the presiding judge in the second case against President Uhuru Kenyatta. The two Kenyan cases have been handled by the same judges since their charges were confirmed in January 2012.  The ICC presidency said that there will now be two trial chambers with judges Robert Fremr and Chile Eboe-Osuji serving in both Trial Chamber V(a) for Ruto and Trial Chamber V(b) for Uhuru. "The decision of the Presidency was taken to ensure the proper administration of justice, taking into consideration each Judge’s workload," a statement from the ICC said yesterday. On May 2, Ozaki said that the workload had become excessive and asked to be excused from the case against Ruto and Sang. She has also been handling the trial of Jean-Pierre Bemba Gombo. "The two Kenya cases have involved an unprecedented volume of filings from the parties, requiring a number of judicial orders and decisions. Significantly, the volume of filings has continued to increase as the trial commencement dates draw nearer, to the point where it is no longer possible for me to review and decide on all of the issues raised in both cases," Ozaki told the ICC Presidency. She added that it is not humanly possible to sit in three simultaneous trials, even setting aside the unique demands of the Kenya cases.

Police believe the mother of 20-month-old Sarah Dahane may be in Kenya

 

A Kenyan mum feared to have killed her toddler before fleeing to Kenya was in a bitter custody row with the girl's dad, police revealed. Angela Whitworth, 40, and her ex Nabil Dahane, 33, were due in court next month over 20-month-old Sarah. Police and social services had also contacted them over non-violent rows. Police believe the mother of a 20-month-old girl whose body was found in a house has fled to Kenya. Sarah Dahane was identified by her father on Friday morning 17th May, 2013 but a post-mortem examination has failed to establish the cause of her death. The hunt for the mother of a toddler who was found dead at her home Bicester, Oxford, UK is ongoing. The mother is believed to have left UK for Kenya on Wednesday evening 15th May, 2013. The mother is not well known by the Kenyan community in the area. She is said to have married by a Moroccan but they had separated. Searches at the house in Herald Way, Bicester, where the body of 20-month-old Sarah Dahane was found on Thursday morning 16th May, 2013, have concluded.

A police spokesman said: "The investigation to establish the exact location of Sarah's mother continues." The woman, who has not been named by police, is believed to have left the UK and travelled to Kenya. The child's body was found by police after members of her family raised concerns for her well-being. Detective chief inspector Ian Hunter said: "I would like to thank the residents and community in Glory Farm for their patience and co-operation whilst we have been conducting searches and inquiries. "We recognise the distress that can be caused as we respond to such sad incidents." The girl's father, Nabil Dahane, who is separated from her mother, formally identified her. In a statement released on Friday through police he said: "You have meant the world to me. "The time spent with you, though has been cut very short, was an absolute joy." A post-mortem examination carried out on the child's body was inconclusive and further tests are to be carried out to establish a cause of death.

 

Officers forced their way into the semi-detached house after Sarah’s dad contacted police when Ms Whitworth failed to drop his daughter off for a visit. Detectives do not yet know the exact time of death, however Ms Whitworth fled the country on Wednesday evening, flying out of Heathrow airport. Police are speaking with flight staff to establish what Ms Whitworth’s state of mind was when she left the UK. Ms Whitworth and Mr Dahane, 33, separated while she was pregnant with Sarah. Mr Dahane now has a new partner who lives across the road from Ms Whitworth’s home of more than 10 years. Police revealed they were called to three domestic rows between the couple between 2011 and last year.

296 Houses to be demolised in Runda, Nairobi

Some of the homes in Runda Estate that would be demolished to pave the way for building of the Northern bypass. Cycads properties and Runda Mimosa Estate had gone to court to stop the demolitions but their bid was unsuccessful.

 

 

At least 296 families in Nairobi’s upmarket Runda Estate will be rendered homeless after the High Court ordered partial demolition of the gated community to create room for the construction of the 21-kilometre Northern Bypass corridor. Lady Justice Mumbi Ngugi threw out twin petitions by Runda Mimosa Estate and Cycad Properties Ltd seeking to stop the government from reclaiming 20 metres consumed by the housing estate from the original 80 metres earmarked for the road expansion. The long-running dispute between Runda residents, Lands and Roads ministries, Kenya National Highways Authority, Kenya Urban Roads Authority and the Attorney-General involved the width of the road reserve adjacent to the palatial houses. While the residents argued that the road’s width is 60 metres according to records in the Lands ministry, the government insisted it was 80 metres as delineated on November 20, 1970. The land, originally owned by Edith Cockburn, covered 6.4 acres when the parent parcels were compulsorily acquired by the government.

The AG, through Mr Charles Mutinda, said that after the compulsory acquisition, the land owners were compensated in respect of their portions and the titles reverted to the government. Others who originally owned the land were Estav Ltd (16 acres) and Runda Coffee Estate Ltd (27.9 acres). The petitioners had urged the court to declare that their rights, individually or in association with others to acquire and own property, were being violated as guaranteed by Article 40 of the Constitution. However, the judge said she was satisfied with submissions by KeNHA’s lawyer, Mr Anthony Mulekyo, that the residents knew of the public nature of the land through Gazette notices that warned the public against encroaching on road reserves and bypasses. “In the two petitions before me, I don’t see any violation or limitation of the residents’ right to property. In my view, the residents are unwitting victims of landowners who sold the properties to them without having regard to the public interest,” ruled Justice Ngugi. She also turned down a plea by the residents that Sh2 billion had been invested in constructing the houses, observing that the right to property can only be exercised within and in accordance with legal framework as public lands had overriding interests under Registered Land Act. “While I appreciate the large investments that have gone into the construction of the residential houses and sympathise with the situation of the owners, I believe their recourse in legal claim is against those who sold land to them,” said the judge.

The judge ordered the Runda residents to surrender to the government the 20 metres out of their respective parcels within 90 days from April 25 and directed the Lands office to rectify the titles accordingly. Mr Mulekyo told the court that the petitioners – Cycad and the 296 residents – were fully aware of the encroachment and “what they are now seeking from the court is to be allowed to clean up their tainted titles”. “The petitioners cannot clothe their encroachment on public land with legality through a declaration of rights that they are not entitled to,” submitted Mr Mulekyo, who urged the court to block the residents from any attempt to gain collateral advantage. The Northern Bypass is a 25-kilometre road linking Thika Road to Waiyaki Way which is part of the Nairobi-Nakuru highway. It runs through Kahawa West, Githurai and upmarket Thome, Windsor, Runda and Kitisuru estates. Drawings dating back to 1970 show the road was designed to use 80 metres and not 60 metres as argued by lawyers Mohammed Nyaoga and Geoffrey Imende for the 296 affected families. Mr Nyaoga said demolishing the houses would infringe on the residents’ right to private property. However, the Kenya Urban Roads Authority, through its lawyer Geoffrey Ondongo and the Attorney-General, who are named as respondents, said the government had spent Sh8 billion in constructing the 25-km Northern Bypass. - Daily Nation.

 

 

 

 

Obama to skip Kenya again in Africa June visit

WASHINGTON, May 21 – President Barack Obama will leave on a first African tour next month, visiting Senegal, Tanzania and South Africa, but his itinerary released on Monday bypasses Kenya, an ancestral homeland. Obama disappointed many Africans by spending only a few hours in sub-Saharan Africa – in Ghana – during his first term, but is keen to implement a sweeping new regional strategy, prioritizing democracy and economic reform. Speculation will center on whether America’s first black president will see ailing 94-year-old South African anti-Apartheid icon Nelson Mandela, on a trip on which he will be accompanied by First Lady Michelle Obama. The White House said the long-awaited visit was intended to underscore Obama’s “commitment to broadening and deepening cooperation between the United States and the people of sub-Saharan Africa” to advance peace and prosperity. Obama will meet officials, businessmen, and civil society leaders, including young people, on the trip between June 26 – July 3 – an unusually long journey for a president who normally dashes across timezones on trips abroad. But early scrutiny will concentrate as much on where he will not go in Africa, as his planned stops, with Kenya, the land of Obama’s late father, where he still has living relatives, a glaring omission.

 

Obama frequently uses his past and background to connect with foreigners, remembering his childhood stays while in Indonesia, his Irish heritage in Ireland, and as a Hawaii native, posing as America’s “first Pacific president.” But politics appears to have scuppered hopes for Obama to reconnect with his roots in Kenya. It would likely be seen as unseemly for Obama to appear with Uhuru Kenyatta, elected president in March, who is due to go on trial in July at the International Criminal Court (ICC) for crimes against humanity in post-election violence in 2007-08. An administration official said on condition of anonymity that Kenyatta’s election had been a complicating factor in setting Obama’s schedule in Africa. Obama did visit Kenya in 2006, shortly after he was elected to the Senate, but before he announced his 2008 run for the White House. His visit to Africa will follow a similar tour made by his wife Michelle in June 2011, during which she met Mandela. While the president is yet to mount a full tour of the continent, he did host a meeting at the end of March with recently elected Senegalese counterpart, Macky Sall, along with the leaders of Sierra Leone, Malawi and Cape Verde, lauding them as examples of “the progress that we are seeing in Africa.”

 

In 2011, Obama received four other African leaders at the White House, the presidents of Benin, Guinea, Niger and Ivory Coast. He had promised them the US would remain a “stalwart partner” to democracies in Africa. In June 2012, Obama unveiled a sweeping new Africa strategy, with the goal of reinforcing security and democracy on a continent facing the threat of Al-Qaeda and a Chinese economic offensive. The new US blueprint seeks to boost trade, strengthen peace, security and good governance and bolster democratic institutions, declaring that a continent torn by poverty, corruption and discord could be the world’s next big economic success story. The administration touted “successes” from helping to restore democracy in Ivory Coast, nurturing the new state of South Sudan, backing stability efforts in Somalia and engaging young African leaders. In his speech before Ghana’s parliament in 2009, Obama proclaimed that even though the continent now needs international aid, “Africa’s future is up to Africans.” Obama’s visit will also likely throw a new focus on the President’s Emergency Plan for AIDS Relief, which was the brainchild of his predecessor George W. London shares reach 13-year high

The FTSE 100 has closed at its highest level for nearly 13 years, finishing 32 points up on the day at 6,756. That leaves it just short of the FTSE's all-time highest finish - the level of 6,930 reached in December 1999. Analysts say investors are increasingly putting their money into stock markets because interest rate cuts had made the return on bonds appear unattractive. Banks were the day's big gainers, with RBS up 4.5% after a broker upgrade. Airline Easyjet was also up 4%. The FTSE 100 has been reaching fresh highs on the back of money-printing measures by central banks, including the Bank of England, which have cut the price of government debt and sent equities rocketing. On Wall Street, the Dow Jones and the S&P 500 have been reaching levels not seen for years.

Jawaid Afsar, a sales trader at Securequity, said the FTSE 100 keeps "grinding higher, and there's no real selling pressure". He added: "Everyone keeps trying to call the top of the market but any wobble is another occasion to buy into it. The momentum is still bullish." The day's other leading performers included BT - up 2.6% - and United Utilities, which rose 2.5% after an upgrade of the sector by Goldman Sachs and recent excitement surrounding the overseas bid interest in rival Severn Trent.

A passenger died on Sunday night after being thrown out of a moving matatu by a conductorfollowing a Sh10 fare dispute. Mr Jared Mang’era Ongaga was travelling to Kericho town from his rural home in Manga district. Passengers travelling in the same vehicle said the deceased differed with the conductor over the fare and upon reaching Nyabioto junction along the Kisii – Kericho highway, he was thrown out of the matatu. Mr Mang’era sustained serious injuries on his head after hitting the tarmac road and died instantly. The angry passengers confronted the conductor who later fled for his own safety. However, the driver was ordered to drive the vehicle to Nyamira Police Station where the incident was recorded.

Two donkeys are to be put down after they dragged a pensioner from his mobility scooter and mauled him to death. Sandor Horvath, 65, was chased and pulled from the scooter at a farm in Hungary, where he was visiting his farmer friend. He was bitten and trampled on, and when his mutilated remains were found it was believed he had been attacked by wolves. However, a post-mortem examination revealed the bites and markings had come from the donkeys.A vet told local media: "Donkeys aren't usually aggressive towards humans. "They probably reacted like this as they thought the victim was intruding upon their territory." A police spokesman said: "If these were dogs then they would also be put to sleep. "We can’t allow animals to go around killing people. Putting them to sleep is the best thing for everyone."The farmer's daughter, Csikos Darda, said: "I had noticed that the donkeys were becoming increasingly aggressive and I'd asked my father to do something about it, but he'd said they were fine."

HANDLING CRITICISM CONSTRUCTIVELY

We read in Proverbs 12:16-18: "A fool is quick-tempered, but a wise person stays calm when insulted. An honest witness tells the truth; a false witness tells lies. Some people make cutting remarks, but the words of the wise bring healing." How can you tell constructive criticism from destructive criticism? By practicing these principles from God's Word: 1) Resolve that whatever it is, you'll handle it constructively. 'A wise person stays calm when insulted.' Angry responses only short-circuit rational thinking and trigger emotion-driven reactions. 'If you listen to constructive criticism, you will be at home among the wise. If you reject discipline, you only harm yourself; but if you listen to correction, you grow in understanding' (Proverbs 15:31-32 NLT). Always ask yourself, 'Can I learn something here? 2) Consider the character of your critic. 'An honest witness tells the truth; a false witness tells lies. Some people make cutting remarks, but the words of the wise bring healing' (Proverbs 12:17-18 NLT). Is your critic trustworthy? Are their words meant to help you? If so, appreciate them and grow wiser. 'Better to be criticised by a wise person than to be praised by a fool' (Ecclesiastes 7:5 NLT). Are their words intended to demean you and damage your self-worth? Words that humble you have a godly purpose, but words that humiliate don't; so reject them. 3) Check your conscience. Paul wrote: 'My conscience is clear...It is the Lord himself who will examine me and decide' (1Corinthians 4:4 NLT). If you're in the clear, leave the outcome with God. He alone sees the whole picture. 4) If you are criticised because of your faith, consider yourself blessed. U.S. Senate Panel OKs Plan to Fingerprint People Leaving U.S.

 

All foreigners departing from the nation’s 10 busiest airports will have to have their fingerprints scanned within two years, according to a plan adopted by a Senate panel Monday. The Senate Judiciary Committee has been debating a sweeping immigration bill to overhaul the nation’s immigration laws for three weeks now, and properly securing the nation’s borders has been a time-consuming, rigorous debate throughout. Republicans on the committee, led by Sen. Jeff Sessions, R-Ala., spent much time last week pushing for a nationwide program to collect the “biometric” data of peopleleaving the U.S., such as fingerprints and iris scans. They want that system to better track so-called “visa overstays” — people who enter the country legally but remain in the county after their visas expire. That group makes up about 40% of the 11 million unauthorized immigrants living in the country.

“If you’re a sovereign nation, you’ve got to control your borders. That’s what other countries do,” said Sen. Chuck Grassley, R-Iowa, during Monday’s debate. That plan was voted down last week when Democrats, led by Sen. Dianne Feinstein, D-Calif., said it was too expensive and too complicated. She and others worried that failure to develop the system, which the government has been unable to implement despite congressional mandates dating back to 2001, would prevent the nation’s 11 million unauthorized immigrants from being able to apply for green cards and U.S. citizenship. Feinstein said she fully supports a “biometric” program but argued that the current system of collecting “biographic” information, such as names and dates of birth, when people leave the country has been successful enough. Mike Sonko goes back to school for College Degree

Nairobi Senator Mike Sonko has joined Mt Kenya University to study business administration. Sonko, who was admitted in the May intake, is to start his evening classes this week. The Senator said he was inspired to go back to school by Deputy President William Ruto who last year graduated from the University of Nairobi with a masters of science degree in plant ecology. “Despite what the DP was going through in regard to the ICC cases, he found time to go back to school so he really inspired me, masomo haina mwisho (there is no end to learning),” he said.

School Hit As Monster Tornado Devastates Town

At least one elementary school is destroyed as a massive, mile-wide tornado ravages a suburb of Oklahoma City. A massive tornado has torn through a densely populated suburb of Oklahoma City, utterly destroying everything in its path - including an elementary school that took a "direct hit". Young children were at Plaza Towers Elementary School in the town of Moore at the time, but it is unclear whether there was a storm shelter where they were able to take cover. Firefighters were at the scene digging through the school's debris to reach any children possibly trapped inside. The town's hospital was badly damaged, and there were also unconfirmed reports that a second school was destroyed. Several other tornado warnings were also in effect in the minutes after the devastating twister hit.

 

I’m too pretty to work: Science graduate

claims good looks forced her out of job

A PhD graduate has claimed she was forced out of her science and medical research job because she was ‘too pretty to work’. Laura Fernee said she quit her £30,000 laboratory job in 2011 after three years due to constant advances from male colleagues and persecution from jealous women. The 33-year-old, who has not worked since, insisted: ‘I’m not lazy and I’m no bimbo.’ In an appearance on ITV’s This Morning she denied to presenters Phillip Schofield and Holly Willoughby she was being over-sensitive, and revealed she was writing a book to help women deal with similar situations in the workplace. Ms Fernee said she had been left traumatised by bullying and harassment all because of her appearance. ‘The truth is my good looks have caused massive problems for me when it comes to employment, so I’ve made the decision that employment just isn’t for me at the moment,’ she told the Daily Mirror in a separate interview. ‘It’s not my fault… I can’t help the way I look.’ While male colleagues constantly asked her out on dates or left romantic notes at her desk, Ms Fernee said women rarely asked her out for after-work drinks and once asked her to face in a different direction because men were staring at her. Ms Fernee now lives off her parents Catherine, 65, and Alan, 70, who fund the £4,500 she spends every month on rent, clothes and going out. ‘I know people will judge me for choosing not to work but they are underestimating just what a curse good looks can be in the workplace,’ she added. ‘Everyone thinks it must be great to be attractive but there are serious downsides. ‘I’m sure other women have experienced the same problems but haven’t spoken out for fear of being labelled big-headed.’

Raila rules out job deal with Uhuru team

Raila Odinga

Cord leader Raila Odinga on Sunday said he was not ready to take up a job with the government because he is already engaged in various international assignments, which are keeping him busy. In an interview with the Daily Nation, Mr Odinga sought to put to rest the job debate, saying he had received no job offer in President Uhuru Kenyatta’s government.

“I have received numerous invitations from across the world. I have accepted some and declined others. This does not indicate to you I am a person who needs a government job,” he said. “There is no offer I have seen and I do not need any job to stay relevant in this country,” he said. “For avoidance of any doubt, let me state here that I will not accept any job if offered by President Uhuru Kenyatta’s government.” Mr Odinga said his “inbox” was full with international and local assignments that will keep him on his toes in coming days.

“What I told the President is that he should resist the temptations to kill the opposition the same way successive governments have done,” he said on Saturday. Mr Odinga met President Kenyatta during the funeral of Knut secretary-general David Okuta Osiany in Kisumu last month.

Our sister publication, Saturday Nation, reported at the weekend that Mr Odinga has not announced his next move because President Uhuru Kenyatta had kept him waiting over a State job. “There was a job in the diplomatic circles, yes, but the President is yet to meet Mr Odinga to firm this up,” an official close to both leaders had told the Saturday Nation. Other politicians close to the former Prime Minister said he was writing his memoirs. But at the weekend, Mr Odinga said that during his talks with the President, he had asked Mr Kenyatta to nurture the culture of opposition politics by resisting attempts to poach from those constitutionally charged with the task of checking the government.-“Accepting a job in government negates the very ideals enshrined in our Constitution,” he said and dismissed reports that he was being offered a government job as “propaganda”. There has been talk that Mr Odinga — who lost the March 4 presidential election to Mr Kenyatta — would be appointed as a special envoy. Such a role would make him a peace negotiator in Africa on behalf of the government.Mr Odinga said the role he wanted to play was that of reorganising Cord to make it a strong opposition force. He said he was soon to leave for a conference in South Africa, before going to Australia and later to the US. “I still hold the view that I can lead a strong Opposition from where I stand and that position has not changed,” he said. And while speaking at the Lutheran Cathedral Church in Nairobi on Sunday where he attended a church service, Mr Odinga dismissed as rumours reports that he had been kept waiting for a job by Mr Kenyatta. “No one has kept me waiting; no one can do that any way. But let me stress here that I have not been offered a job, I have also not asked for any,” he told the congregation.

He said he was busy strengthening Cord so as to keep the Jubilee government in check. “There is danger of sliding back to the dark days, if we relax,” he warned. “We want to offer constructive opposition to the government. Of course, we will not just oppose for the sake of it; we will adopt a bipartisan approach in Parliament whereby we will support government when they are on the right track and where we feel all is not right, we oppose, but all in the interest of Kenyans.” Mr Odinga said the fact that he had lost in the presidential poll had not deterred him in the quest to offer Kenyans an alternative brand of leadership. “The process must continue and I am determined to achieve this,” he said.

 

 

 

Attempt to steal Mutula’s half a million casket thwarted

Makueni, Kenya: Police in Mbooni have been deployed to the rural home of the departed Makueni Senator Mutula Kilonzo following an attempt by suspected thugs to break into his grave. Mbooni East OCPD James Baraza confirmed they had received information that some people had planned to steal the casket containing the remains of the late Mutula. The incident reportedly happened on Friday night though relatives declined to discuss the matter referring reporters to the police. The police boss said the suspects did not accomplish their mission as employees and neighbours raised the alarm forcing them to flee. The number of the suspected raiders could not be immediately established but the OCPD said investigations have been launched. “We received intelligence reports that there were some people planning to raid the Woyani home of the late Mutula and moved with speed to tackle the matter,” said Baraza. - The Standard.

Terror suspect killed in night of gun battle

The man who hurled grenades that injured six police officers during a 12-hour confrontation in Nairobi’s Githurai Kimbo on Sunday was a wanted terrorist. Police said Felix Nyangaga Otuko, who was shot dead together with his wife, was the main suspect in the 2011 terror attack at Mwaura’s Pub, off Tom Mboya Street in Nairobi. They further said he was an accomplice of al-Shabaab member Elgiva Bwire, who is serving a life term after pleading guilty to terror charges. The man rarely communicated using a mobile phone and managed to escape the police dragnet for almost 20 months when he was on the detectives’ radar. Neighbours said he led a very private life. “We never saw them during the day for the period they lived here, although that is normally the nature of people in Nairobi. Their situation was, however, rather exceptional. You couldn’t see them even during weekends,” the couple’s neighbour, Mr Stephen Mochanda, said.

Opted to go upstairs

Another neighbour, M- Janet Wanjiru, said she saw the couple for the first time when police ordered all the residents to move out. The couple, however, opted to go upstairs, she added. “In fact, I only saw them when they were moving in the opposite direction from their ground floor house,” Ms Wanjiru said. The residents spent Saturday night out in the cold. Others could not sleep due to the pungent smell of tear gas. “We have not slept because the air here has been full of tear gas since yesterday,” Mr Andrew Omoto, a resident, said.

Officers from the Crime Scene Support Services took fingerprints of the terror suspect’s wife to establish her nationality and other personal details. Six officers were injured during the 12-hour operation where police also recovered two live grenades, parts of four expended grenades and 64 rounds of ammunition.

The officers stormed the three-storey building on Saturday around 7pm and ordered all residents out. They all got out except the couple, with their eight-month-old daughter. They moved from their one-bedroom house on the ground floor to the first floor, and lay in wait. As the first officers entered the gate, the suspect hurled the first grenade at them. Five officers, including the Githurai Kimbo Police Station commander, were injured. The officers resorted to using live ammunition but without success. Officers from the General Service Unit’s Recce Company were called to reinforce their Anti-Terrorism Police Unit counterparts. For the better part of Saturday night, heavily armed officers surrounded the building. The operation resumed early yesterday morning and the suspect threw three other grenades at the officers, slightly injuring an officer from the Recce Company.

Little girl was unscathed

During the confrontation, the couple used their own daughter as a human shield, hoping the police would be reluctant to attack. They were finally shot dead on Sunday at around 7am. The little girl was unscathed. Police suspect that shrapnel from the second grenade the couple hurled at the officers injured them. The man, who was injured in the waist, tied a cloth around it to stop the bleeding. The shrapnel also seriously injured the wife on the right wrist.

CAUGHT AT PRESIDENT UHURU'S MEETING IN LONDON

They came from far and wide to see their newly Elected President Uhuru Kenyatta in London Inter-Continental Hotel on Tuesday 7th May, 2013. Some arrived at the hotel as 12.00 noon to wait for the occasion at 7.00 p.m. Others came as late as 10.00 p.m. explaining of transport problems. They came as far as Republic of Ireland, North Ireland and some others from Europe. It only half of the guests who managed to enter because the house was full. With 4 days notice to organise the meeting, the Kenya High Commission had a very short time to do all what they did. They did their best even after passing a lot of challenges. Many came and took time to take some memorable photos. We will keep on bringing more photos throughout the week. If you were there keep on checking.

A Kenyan who admits killing up to 400 people

He worked for a mob behind some of Africa’s worst atrocities but has been living here in a taxpayer-funded home since 2003. A murderer who admits killing up to 400 people – many in bloody machete attacks – is living in the UK after being granted asylum. John Thuo has been living in a taxpayer funded home since sneaking in illegally from Africa in 2003, and his neighbours are totally oblivious to his grisly past. For seven years he worked for the Mungiki in Kenya, a criminal mob behind some of the continent’s worst atrocities. Thuo, 27, admitted at an immigration tribunal to killing “about 100 to 400 people”. He even said he had taken part in the sickening practice of female genital mutilation. But despite many attempts to boot him out, Thuo remains here, claiming deportation is against his human rights as he will be killed by the gang on his return.

 

British police are not monitoring him or even investigating his crimes. After we tracked him down, Thuo said: “It’s true, I killed a lot of people. I don’t like talking about my past. "I feel guilty for what I’ve done. I feel remorse. “I’ve started a new life here and I’m looking for regular work. If I go back they’ll kill me. They’ll behead me.” Asked if he is monitored by the Home Office, he said: “No, I don’t have to meet anyone. I’m free. "My life in Kenya is in the past. It’s a different world out there. Out there, all you can do is hope to survive. This is a better place to live.” Thuo has been living rent-free in accommodation provided by the National Asylum Support Service. The killer has worked as a removal man but receives £160 a month in pocket money through benefits provided by the NASS. One neighbour in suburban Coventry said: “He’s quite a big drinker. "He’ll buy bottles of vodka and get drunk. When he does that he gets aggressive. He doesn’t talk about his past much. “I had no idea about him killing all those people. It’s terrifying really. There’s a lot of children who live in this street.

 

"There’s a Mr Whippy ice cream van that parks outside his house. The children line up along the fence to his garden.” The Home Office has tried to deport Thuo in a series of hearings but it has been unsuccessful. This is despite Thuo telling an immigration court in London he was a senior member of the Mungiki in the Kariobangi slum of Nairobi, after joining when he was just 10 years old. The Mungiki recruit child members and Thuo’s first job for the gang was to spy on people who were selling illegal alcohol in the poorest areas. In 2000 he was promoted to leader, training members and taking control of the Korogocho slum where he ran a security racket. In evidence he said he “attacked police and stole their ammunition”. He also admitted his gang “torched people’s houses” and carried out female circumcision and public intimidation. In 2002 he took part in a revenge attack on villagers who had killed two members of the Mungiki. He butchered two ­civilians with a machete.

 

In another incident he said he killed two police officers after members of the gang were arrested, one with a machete and another with a “big stone”. The Mungiki – part gang, part religious sect – were outlawed in Kenya in 2002 following widespread outrage at their horrific crimes, in which victims were left as mutilated corpses. Members are required to take secret oaths and the mobsters are linked to political violence and extortion. They engage in fraud, robbery, murder and kidnap. It is also thought members drink the blood of their victims. The Mungiki emerged as a major force in Kenya in the 1980s. Initially they were a peaceful protest ­movement in which followers wore dreadlocks, but the group transformed into one of the most feared organised crime organisations in the capital, Nairobi. Some defectors claim there are millions of members. The mafia-like gangsters control public transport routes and provide illegal water and electricity connections to hundreds of makeshift shacks in some impoverished slums.

 

Residents also have to pay them a levy to access communal toilets and for ­overnight security to protect them. Elinah Kakmega, 33, lost two brothers in a Mungiki machete attack in Nairobi 10 years ago, at the time Thuo was active. She said: “They pounced on my brothers in the street outside our home and tore their bodies apart with their weapons. "When they were found their bodies had been hacked apart. “The men were like a pack of wild animals. If John Thuo admits his part in attacks like this he should be brought to justice. "It is terrible that he has been able to enjoy a new life in Britain while we suffer here every day.” Thuo arrived here as an illegal immigrant in August 2003. He kept his identity a secret until he needed the help of the NHS for mental health problems. In March the Immigration and Asylum Chamber granted his appeal under the Human Rights Act against being removed from the UK, after an expert gave evidence the Mungiki were known to behead members who tried to flee.

 

The judge also took into consideration Thuo’s mental health, and threats he would kill himself if he was deported. He has now been granted indefinite leave to stay in the UK, but he will have to apply ­­for an extension in three years. Senior Labour MP Paul Flynn said: “This case is one of the worst I have seen. "It has been proven time and time again that the immigration system has some serious problems. “Laws which were created in good faith are being used and abused by criminals and this is something which has to stop. "It is extremely worrying that someone who has admitted to killing so many people is not being investigated by the police in this country. “And it is even more worrying he is able to successfully claim asylum despite what he says he has done.” A spokesman for Aegis Trust, which campaigns to prevent crimes against humanity worldwide, said: “Anyone suspected of international crimes should be held to account.

 

“We would call for a further investigation of this extremely concerning matter by the authorities.” In 2007, Mungiki followers were accused of a series of gruesome murders in Central Province, in what was said to be a revenge attack on people who had leaked information to the police about their activities. And two years ago six Kenyans accused of being members faced charges at the International Criminal Court over ethnic violence that brought the country to the brink of civil war in 2008. At the time, a former Mungiki mobster said in a statement to the court in The Hague: “If a member disobeys, they would cut that member’s head off and put the head in public view at the place where they had a problem with the member.” Last night a spokesman for the Home Office said of Thuo: “We cannot comment on individual cases. – The Mirror, London

 

 

 

 

UPDATES OF THE DIASPORA VILLAGE PROJECT IN ISINYA/KITENGELA

The Patron of Diaspora Village Project in Isinya/Kitengela in Kajiado, Kenya Mr. Peter Kahoro had done some homework before sourcing for this project. The land he sourced is now heading to be in one of the most strategic points in Kajiado with the new Bypass Road and Namanga Road meeting there. These might mean that at the end of it all Kajiado town and Kitengela town will be overtaken by these new junction town. The Bypass road heads down to Koza City then down to Mombasa Road. When the new Bypass is complete, vehicles from Mombasa to Nakuru will no longer pass through Nairobi city but it will be passing through Koza City, Isinya, Ole Polos, Suswa, down to Mai Mahiu, Naivasha and down to Nakuru. The Dispora Village has now taken a big turn. Because of its popularity within the area, the road from Namanga Road to the site has been named Diaspora Road by Kajiado physical planning department. Much more land has been sourced within the same locality. Now the project will comprise of Blocks A to E. Block A is all now sold out. Block B which is 74 Plots, Block C which is 74 Plots, Block D which is 148 plots and Block E which is 120 commercial plots next to the already completed factory.

All the plots are 1/8 of an acre and this time there are no 1/4 plots. There is also a police post and supermarket area within Block D and E. The prices and value of all these plots continues to rise. Those who bought the plots in Block A in last April,  bought it at KShs. 400,000. New Services For the Benefit of the Diaspora Community

Greetings!

 

For over 10 years, I have worked and served the Kenyan Diaspora Community in the UK in my capacity as a Solicitor of the Supreme Court of England and Wales. During this time I have had the privilege to advice and assist many individuals and families in their legal matters.

Although majority of the pressing needs for the Diaspora community have been resolved as individuals and families have gained settled status in the UK, over the years, I have witnessed recurring problems within the community. These include the lack of opportunities to invest through deposit accounts, housing, pension schemes, unit trusts to name but a few products. I have also observed a lack of insurance products catering for the specific concerns of the Diaspora community such as the hefty medical bills for family members in Kenya, access to medical treatment in UK, difficulties with payment of school fees, challenges with transfer of title from relatives granted power of attorney, management of assets, problems with acquiring properties in Kenya through a legitimate and trustworthy conduit amongst other concerns.

 

As these problems have reoccurred time and again with repeat enquiries from old and new clients, I have wondered for sometime if there was a workable solution out there that can assist thousands of the Diaspora community not just in UK but anyone outside Kenya. I am very pleased to inform you that following research and enquiries over time, I have successfully negotiated services that would benefit thousands in the Diaspora and their loved ones in Kenya.

 

My main concern was, and still is, based on and centered round the fact that the Diaspora is not what it is often portrayed to be...a gravy train or indeed a berry picking expedition.

 

The reality is indeed distinctly different from the depiction.  There are real challenges facing Kenyans at all fronts in the Diaspora that have made it virtually impossible for those whose initial plan was to live in UK for 5 years  and return to Kenya after achieving their goals to do so. For most members of the Diaspora community, for 20+ years following their entry into the Diaspora they are still planning to return and retire in Kenya, with many having achieved little of what they had planned to or indeed not attaining their goals at all. Such a person, notwithstanding their circumstances, still holds the dreams of living in comfort, educating their children, assisting their family members, investing to enable them continue living in comfort during their sunset years amongst other goals.  The question I have asked, and continue to ask myself over the years is, how practical would it be for this person who has been unable to attain their initial goals to leave the UK and return to Kenya? If the person travelled to UK in 1994 aged 45 years, today that person is aged 64 years and in my experience, following a brief conversation with them, they will tell you that they are still planning to return to Kenya somehow someday!!

 

There is another reality that faces the Kenyan Diaspora Community- Kenyans in the Diaspora have different job occupations and earning capacity!. Majority of those who work in some of the more reachable jobs such as security, care, live-in jobs to name some have not been able to catch up with the minority of Kenyans living in the Diaspora in white collar or self employed positions due to their limited earning capacity. This has made it impossible or at best slower for these persons to invest in Kenya dutifully as they would. This problem is compounded or amplified in those Kenyans living in the Diaspora who are not able to travel to Kenya regularly or not able to make travel arrangements at all for various reasons.

 

Additionally, the banks or investment companies or other ventures plat formed for the Diaspora have failed to take into account the needs of these groups of persons. I have observed that the available investment opportunities offered have over the years ranged in millions with hefty deposits and penalties capturing only the fortunate few. Of course majority can only realistically afford to deposit about £50-100 per week or month because of their earning capacity and given the time, direction, guidance and proper management of their investment assets, such persons' limited deposits could yield to something fruitful and financially viable in the long run. The question I have repeatedly asked myself over the years is who has considered this group? The enquiries I have raised and research I have undertaken in order to seek an answer to this question reveals that whilst majority of Kenyans living in the Diaspora fall within this category, major banks, insurance and investment companies have never actively advanced their products to the group or in some cases, have not tailored products that adequately cater for the needs of the Diaspora Community.

 

There is another class of persons who make up the Diaspora Community- those who have been fortunate enough to have invested and/or are still investing through their relations in spite of the fact that they are unable to travel to monitor their investments for various reasons. Over time, I have observed that even this group of persons experience some challenges in concluding or monitoring their investments which include difficulties in having the property titles transferred into their names from the names of relatives whom they used to facilitate the conclusion of the purchase of the property. They also face difficulties in managing their assets to ensure that they yield maximum returns. Many clients have over the years informed me that they find the exercise of managing their assets and/or seeking the transfer of titles into their names to be taxing and time consuming, particularly given that they are forced to deal with third parties or proxies as they are unable to travel to Kenya in person for various reasons. This has resulted in ongoing court battles and family feuds.

 

The notable good news is that Kenyan laws have over the years changed to the benefit of the Diaspora community. Sadly, in spite of this, I have observed that those in the Diaspora have little or no knowledge of the same. From my experience with sampled cases, hundreds of Kenyans have lost their investments because they either do not want to engage in legal battles or just do not know what to do. The problem is aggravated if a person dies in the Diaspora without having drafted a will. In such a case, having their investments transferred to their wife/husband/ children by those granted Power of Attorney is proving difficult by the day. These challenges have informed my decision to seek practical solutions for persons within the Diaspora Community that may be exercised during their lifetime, when the person investing has an active hand in the control, management and choice of their investments.

 

Moreover, every now and then, I hear of a harambee for funeral arrangement, school fees or medical bills within the Diaspora Community. The reality is that the members of the Diaspora Community, like any other persons, have ongoing responsibilities to their family members which include meeting these hefty bills. The Diaspora Community has to date, not been actively advanced with the opportunity to takeout medical insurance cover in Kenya for their children, wives, husbands or relations. However, with only Kshs 100 thousand per year one is able to cover a family of up to three (3) with both in and out patient cover including, prescription, diagnostic, maternity costs to name a few benefits. Should the Diaspora Community be afforded an opportunity to take on such insurance cover in a active, efficient and timely manner, I am sure that it would be greatly welcomed given that the treatment and diagnostic of serious and terminal illnesses costs between Kshs 30 to 60 thousand per visit.

 

Yet again, for those with children or relatives of school age, paying school fees has not been easy especially at a time when the recession is at its peak. However, my enquiries and research have revealed that there are school fees and education plans available from reputable insurance companies that are able to enable you to pay school fees in times of need such as in case of redundancies, layoffs, death of a spouse or financial partner, unemployment or indeed retirement. The insurer meets the school fees cost in full spread out over the months making it a much more convenient, efficient and effective way of shouldering the obligation particularly should you have several relations to educate.

 

As for those who wish to retire in Kenya and are currently undertaking jobs in the Diaspora that do not have a pension kitty, you can now have one. I have managed to negotiate with various reputable investment companies for products that suit the needs of the Diaspora Community catering for the varied earning capacities. It is up to an individual how much they wish to deposit in their pension or unit trust fund and again, it is up to them when you wish to retire. In addition, the investment companies would provide specialist investment and financial advice from reputable and trustworthy companies to enable individuals make a decision that best suits their circumstances.

 

WAY FORWARD

 

Loans/Mortgages

To make my thoughts a reality, although not a declared solution, I have negotiated favourable, practical and above all reasonable packages with several banks, fund managers, investment and insurance companies in Kenya. The packages are suitable and meet the circumstances and needs of the Diaspora community. The loans, mortgages, investment and insurance opportunities negotiated cover those who can only pay minimal fees like £50-200 a week. This will enable those at the bottom of investment ladder climb up slowly as the interest rates range from 10%. The banks are also prepared to take up the investment projects on behalf of those who own plots and fund the project with a view of loan repayments from the rent generated or lend funds using the title as the security.

 

Medical Insurance

 

For those with loved ones who have been paying hefty medical bills, you can now take-up insurance cover for your family members and you will not have to worry about the medical bills, particularly unexpected ones. The cover is for both in and out patient from 2million. Those in the diaspora who cannot access medical treatment can now obtain worldwide cover

 

Pension scheme

 

For the many who have desired to retire in Kenya and have wondered how they will survive without any form of income you can start building your pension and investment pot and retire when you want.

 

School fees plans

 

The banks have agreed to pay in advance the full school fees and you can spread the repayments over the year or months depending on an individualscearning capacity.

 

Will drafting

AFTER RELOCATING FROM LONDON TO NAKURU WITH A MISSION

Mr. & Mrs. Ayub Wainaina arrived in the UK for than 15 years with their three children. They settle in Enfield Ireland in North London. Working hard to push on with life, the couple had dream, a dream to help the unknown in Kenya. This is a response to the call of God in their lives to minister to the needs of orphaned, the neglected, rejected and abandoned babies and children. Ayub and Irene Wainaina are the founders of St. Ann Baby and Children’s home in Nakuru, Kenya. After relocating to Nakuru they bought a land in Nakuru where they are constructing a home for the orphans (See photo below). They have completed the building but they have run short of cash to finish inside - they need your support. They are holding a dinner on Friday 5th April, 2013 in a Nakuru Hotel - See card below.

Changes to Immigration Rules for Overstayers/family dependants from 6th April 2013

In October 2012, Immigration rules [Para 276AD were amended providing a provision for anyone who has been in UK legally or illegally for less than 20 years and can show that they do not have any social ties in their country of origin will be granted leave to remain. Information/warning wasprovidedstating that although the changes looked promising once the UKBA noticed the wide requirements[ anyone could send the application regardless of how long you have been in UK] and that anyone in UK for less than an hour can apply for leave provided they can show that they do not have social ties in their country of origin, the rules would be withdrawn or amended. This appears to be the case now after only 4 months into the new rules.

 

Unfortunately or fortunately, few people have taken notice of the changes and taken action to submit application for consideration since the rules were introduced. For those who haven’t, the Home Office have announced that the rules will be changed and/or deleted form 6th April 2013.

NB: information was provided for student graduates who wished to submit applications for work permit following the withdrawal of PSW under new rules introduced in April 2012. Those who took action did and were granted leave for 3 years but those who didn’t the rules were amended/deleted on 13th December 2012 after overwhelming applications were received for consideration.

Thus if you are an overstayer in UK and have not submitted an application to the home office to legalise your status in UK, seek legal advice on or before 6th April 2013.

How entrepreneur turned childhood dream into Sh2bn resort

In 1982, Julius Kamau, then a college student, dreamt of standing on top of his own beautiful hotel with water fountains and flowers sipping coffee. For the young man from a poor family, the prospects of realising that dream then appeared remote. ‘‘I then laughed at myself... I was as broke as a desert rat,” Mr Kamau says. Thirty one years later, his daughter Pauline Kamau sits at the Rainbow Ruiru Resort’s reception attending to a client— a hotel that her father has built. Mr Kamau started the journey to fulfil his childhood dream in 1998 while living in East London. While shopping for vegetables in the foreign land he recalled the dream. He took the first step. “In January 1998, I asked a Nigerian friend to put this dream into a real picture. He did it and I hanged the picture on the wall. Every morning, I would look at it and say, ‘thank you Lord for giving me a wonderful five-star hotel,’’ he says.

 

In May the same year, he took the next step. He mortgaged his house and asked his brother to look for one acre piece of land in Ruiru. His brother got him a piece of land but he was disappointed as the land was an abandoned quarry that Ruiru Town Council had earmarked as a dumping site. Little did he know that it is at this quarry where his dream was to be turned into reality.  Today, he has the Rainbow Ruiru Resort in Kiambu County to show for his hardwork, managing to set up an investment in a remote area; a resort many of his friends thought was a waste of money and time because of its location.  It is the serenity and the ambience that draws visitors to the over Sh2 billion resort. Its interior design resembles a royal yacht. The hotel that took Mr Kamau 15 years to build has a helipad, 130 rooms, 12 fully furnished apartments with Internet, a pent house, a cocktail bar, jacuzzi, gym and a business centre. It has a 300 bed capacity. Accommodation charges range from Sh4,400 to Sh9,900 per night. At the hotel’s 11 floor which houses the helipad, one can see Kilima Mbogo at a distance and the illusion of the mountain moves closer as one watches it from the rooftop. Constructing the resort was not an easy task. Mr Kamau who runs a security firm, Rainbow Guarding in the UK says the Ruiru investment was funded by savings.  Rainbow Guarding was founded in 1994 and offers security solutions to Berkley Homes, Laing Partnership Housing, Salvation Army and London Property Plc among other companies in UK.

‘‘The owner believes his entire life could not be confined in London,’’ said Mathias Mukundi, the general manager of Rainbow Ruiru Resort. Ms Kamau has been taking care of her father’s investment; a project she says is a well calculated decision of how Kenyans are sending some of their earnings back home instead of investing all their money in a foreign country.  Mr Kamau came from a humble background and the desire to rise from poverty inspired him to seek a different life. Now 59, he can stand among Kenya’s millionaires, but according to his workers, a humble millionaire. ‘‘The founder is one of those people who despite having immense wealth, he does not use his position to gain prominence, he does not believe in fame but on humane values that can give birth to development-oriented ideas,’’ said Mr Mukundi.  Mr Kamau who still lives in the UK connects tourists visiting Kenya to his hotel. The hotel management also works with local tourism agents to market Rainbow Ruiru Resort. The team is working on ways to make own bookings directly in coming years. ‘‘We want to create a clear contact where tourists visiting Kenya will be flown from the Kenyan airport by our own choppers direct to our hotel, landing at our modern helipad,’’ said Mr Mukundi. Mr Kamau has entrusted Mr Mukundi who has been in the hospitality industry for 25 years, having worked with major hotel chains in Kenya among them the Sarova Hotels to run his hotel.

Though not a hotelier, Mr Kamau has built the hotel to take advantage of an increasing number of tourists and business travellers coming to Kenya and local visitors seeking adventure in places out of town. ‘‘For years there has never been a hotel in Kiambu County that could accommodate large number of clients and offer services that we are offering now,’’ Mr Mukundi says. ‘‘We are optimistic that this investment will successfully run for decades, we are ready to add values that blend with my father’s aspirations when he was setting up this hotel,’’ said Ms Kamau, who also acts as the hotel’s deputy manager. East African Breweries is one of their main clients and Mr Mukundi is optimistic that with the new devolved system of government, Rainbow Ruiru Resort’s conference facilities will lure more visitors.  ‘‘Thika Superhighway has come as a blessing, with the hotel being a few meters from the main road, the demand for decent yet affordable accommodation is inevitable. We are doing well compared to previous years when Thika road was rough,’’ he said.  Mr Mukundi said there Kenyans in the diaspora should be encouraged to invest back home. He said it is worrying that only a small number of Kenyans are remitting their earnings and investing here. - Daily Nation.

 

 

 

 

 

WHERE IS THE DIASPORA VILLAGE IN KITENGELA/ISINYA?

I visited the proposed Diaspora Village, Kitengela/Isinya plots during my last month's visit to Kenya. Before visiting the projected I was advised by experts to be careful  the services - 3 items - access road, water and electricity. I was taken to the project by the project manager, Dr.  David Kahoro, a doctor in Aga Khan Hospital who is also a brother to Mr. Kahoro Kihara the Director of the project who lives in UK. After driving past Kitengela, then Kisanju, I started asking him whether we were on the right track. He assured me that the land was half a mile after Isinya town. In a short time we were in Isinya and in three minutes we came to a junction where we turned left. I asked him where the wide turning road was heading to. He explained that  this was Isinya Konza City Road heading up to Mombasa Road. "This is the only road heading to Konza City from Kitenga/Namanga Road. By the way Mr. Seed this where the Bypass Road to Nakuru is passing. From Mombasa the vehicles heading to Rift Valley will not be passing through Nairobi, it will be passing through here, South of Ngong a place called Olepolos, Suswa then down to Mai Mahiu. By the way do you know now that Nairobi comes up to Kajiado, we are in Nairobi now. These areas have become popular because it is only area where you can be able to do controlled developments." Dr. Kahoro explained.

 

The factory is on it's completion and on British farmer land on right

From the turn on the main road, on left is Gichuru of Kenya power land, on right is a British farmer who have done a number of farming here including bee keeping. The second farm belongs to speaker of the Kenya assembly Mr. Marende, third farm is a Asian farm and then the Diaspora Village. The Asian landlord has already started building roofing sheet factory (store) next to the Diaspora Village. The road to the village is good, there is water passing on the land and the electricity lines are within the land. The land is in a good place. The Bypass road is passing at the  bottom  of the factory farm few meters from the Diaspora Village. The original owner has agreed to sell an extra land to Kahoro adjacent to the previous land. Half of the extra land has now been divided into extra plots and half of the extra land is going for an estate. Kahoro's as developing an estate in the Diaspora Village. Title Deeds now ready and arrangements are under way for Mr. Seed and Kahoro to issue the Title Deeds in a ceremony to the owners in UK, Germany and USA in a few weeks time. (see below).

Many of you are calling to ask for the different ways of paying for your plots. I have put together all the options available.

The standard terms are 10% deposit and balance in full in 90 days. If you put down 20% we are able to give you 6 instalments for the balance interest free. However, you want longer than that, we have a panel of banks that will finance for up to 24months. Interest range from 16% - 24%.

If you put down 20% on the plot selling at KShs. 550,000, the balance can be paid at Ksh 23400 to the bank over 24 months. There is a bank lending in GBP at the rate of 8%. The repayment after 20% deposit is GBP 146.
